Copyright for artwork is transferred to the customer upon receipt of final payment. Emerick111 does, however, reserve the right to use any work for promotional purposes.
Photo or image copyrights
The author of a photo or image owns the copyright of the work. The author of a photo or image is usually the person who snapped the shutter or created the image. If you took the photo, you own the copyright. If a professional photographer took the photo for you, then he or she owns the copyright. If that photographer is an employee of a studio or other person in the business of making photos, then his or her employer is considered the author.
Copyright requirements before you submit images or photos
Emerick111 requires you to own the copyrights of digital photos and digital images you submit for enhancements. If you are not the owner you should obtain worldwide rights to copy, enhance and modify the image from the owner of the photo. You should be able to produce evidence that you are indeed in possession of the above said copyrights when requested.
Transferred copyrights to Emerick111
When you order services from Emerick111 you transfer Emerick111 the worldwide rights to display, copy, alter and produce derivative works of the content you submit.
Copyrights owned by Emerick111
Emerick111 retains the ownership of worldwide rights to the modifications it has done to your photo or image.
Copyrights Emerick111 transfer to the customer
When the customer has payed for the completed work, he gets the copyrights to copy, distribute or print the image on any medium for personal purposes.
The customer however does not get the right to sell, alter or produce derivative works. In case you require such copyrights please supply details of your requirements.
Website design copyrights
Copyright to a website design is passed to the client upon payment, or in the case of work undertaken in stages, rights to individual features may be handed over for work completed to date, upon payment.
Emerick111 reserves the right to deactivate any website in the event payment for work has not been received.
